Terms and Conditions

These Terms and Conditions govern access to and use of www.semperjob.com (the «Platform»). They also explain how we process personal data and use cookies. By registering or using the Platform you accept these terms. If you do not agree, please do not use it.
1. Platform owner
In accordance with Spanish Law 34/2002 on Information Society Services and E-commerce (LSSI-CE), the Platform belongs to:
2. Purpose of the Platform
The Platform is an active job portal focused on the Costa del Sol, especially tourism, hospitality and related services. Its main purpose is to make candidates’ availability visible to companies so that companies can count on them. Companies find staff who need to work immediately, and candidates find a job quickly.
There are three types of account:
- Candidates: people looking for a job, an internship or work experience. They publish their profile, CV and availability so companies can find them. Candidates cannot search for companies.
- Companies: sign up to find staff for their businesses. They view candidate profiles, download CVs and contact candidates directly.
- Real estate agencies and agents (API): list rental accommodation so that candidates relocating for work have somewhere to live. They do not have access to candidate profiles.
The Platform puts the parties in touch but is not a party to any employment, internship or rental relationship between them. It does not guarantee that any candidate will be hired or that any job or home will be available.
3. Registration, activation and fees
- Registration is free for candidates.
- Registration and activation for companies has a monthly or annual fee: according to the current rates, which are communicated before subscribing.
- Registration and activation for agencies and agents has a monthly or annual fee: according to the current rates, which are communicated before subscribing.
Company and agency accounts remain pending until the Platform owner reviews and approves them. The owner may reject or suspend an account if its details are not truthful, if the fee is not paid or if these terms are breached. Unless stated otherwise when subscribing, subscriptions renew for equal periods and can be cancelled at any time before the next renewal by writing to . Cancellation takes effect at the end of the period already paid.
You must be at least 16 years old, the minimum working age in Spain, to register.
Closing your account. Any user can close their account at any time from their dashboard using the «Close my account» option. After a second confirmation, the account and all its data (profile, CV, photo, company details, properties and photos) are permanently deleted and cannot be recovered or accessed again. We will send an email confirming the closure. For companies and agencies, closing the account ends the subscription immediately.
4. Terms of use
4.1. Obligations of all users
- Candidates, companies and agencies/agents must provide truthful, accurate and up-to-date information. Anyone providing false information is responsible for any damage caused, and their account may be suspended or deleted.
- Login credentials are personal. Do not share them, and let us know if you suspect misuse.
- Using the Platform for unlawful purposes, publishing offensive or discriminatory content, sending unsolicited advertising or trying to access other users’ data is not allowed.
4.2. Candidates
- Candidates must always state whether or not they are available to work, and at what times. The Platform’s main purpose is to provide companies with people who need to work immediately, so keeping availability up to date is essential. If you find a job or stop being available, switch your availability off.
- Candidates only appear in company searches when their profile is complete and marked as available.
- Candidates’ CVs and profiles are not published openly on the website. They are not accessible to the public or to internet search engines: only registered, verified companies with an active subscription, and the Platform owner, can view them.
- Protection against fraud and scams: before activating a company account we verify its details to confirm that it is a genuine company looking for candidates to fill vacancies within its own organisation. No company may ask you for money, bank details or any kind of payment to take part in a recruitment process. If you receive such a request or a suspicious offer, let us know at .
- Candidates must not include special categories of data (health, beliefs, religion, trade union membership, ethnic origin, sex life or sexual orientation) or third-party data in their profile or CV.
4.3. Companies
- Verification: to prevent fraud and scams, before activating the account we verify the company’s identity and activity using its tax details (company name, tax ID and registered address) and any other information or documents we may request to confirm that it is recruiting staff to fill vacancies within its own organisation. We may refuse, suspend or cancel the account if the details cannot be verified or turn out to be false.
- Exclusive use of candidates’ CVs and data. Using candidates’ CVs and personal data for any purpose other than the one provided for on the Platform, which is offering employment by managing recruitment processes to fill vacancies within the company itself, is strictly prohibited. In particular, it is prohibited to:
- disclose, transfer, sell, rent or make available to third parties, by any means, candidates’ CVs or data, including other companies in the same group, placement agencies, temporary employment agencies or intermediaries;
- use them for commercial, advertising or prospecting purposes, or for any purpose unrelated to offering a job;
- add them to their own databases or files for uses other than the recruitment process, or keep them after the process has ended beyond what data protection law allows.
Breach of this obligation will result in the immediate cancellation of the account, without prejudice to any administrative, civil or criminal liability of the company under the GDPR and the LOPDGDD.
- They must process that data in accordance with data protection law, as independent controllers from the moment they download it or contact the candidate.
- They must comply with employment, equality and non-discrimination law in their recruitment.
4.4. Real estate agencies and agents
- Verification: to prevent fraud and scams, before activating the account we verify the agency or agent using their tax details (company or full name, tax ID and address) and any other information or documents we may request to confirm their real estate activity. We may refuse, suspend or cancel the account if the details cannot be verified or turn out to be false.
- They may not ask candidates for payments, reservation fees or deposits before the candidate has visited the property or been able to confirm that it exists and is available.
- Listed properties must exist, be available for rent and be described truthfully: photos, size, monthly rent, deposit and features.
- They must comply with rental and real estate intermediation law and remove listings that are no longer available.
5. Personal data protection
We process your data in accordance with Regulation (EU) 2016/679, the General Data Protection Regulation (GDPR), and Spanish Organic Law 3/2018 on Personal Data Protection and Digital Rights (LOPDGDD).

- Data we process: identification and contact details, date of birth, town, driving licence, availability, languages, education, experience, training, skills, housing needs, photo (optional) and CV (candidates); company and contact person details (companies and agencies); listed property details (agencies); and technical browsing data.
- Purposes: managing your account; enabling approved companies to find and contact candidates; enabling candidates to find accommodation; managing subscriptions and invoicing; answering enquiries; and, only if you accept, analysing site usage for statistical purposes.
- Legal basis: performance of the Platform terms you accept when registering (Art. 6.1.b GDPR); your express consent, given when registering, to the processing and disclosure of your personal data for the purpose of managing recruitment processes (Art. 6.1.a), which you may withdraw at any time by closing your account; compliance with legal obligations such as tax obligations (Art. 6.1.c); and your consent for analytics cookies (Art. 6.1.a), which you may also withdraw at any time.
- Recipients: candidates’ profile data, photos and CVs are visible to registered and approved companies, which is the essential purpose of the service. Agencies’ contact details are visible to candidates viewing their properties. Providers of technical services to the owner (web hosting, email and, if you accept, Google Analytics) also access data under the contracts required by the GDPR. Some providers may be located outside the European Economic Area; such transfers rely on adequacy decisions or standard contractual clauses.
- Retention: while your account is active. When you close it, we erase your account and all your data, including your CV and photo, except for data we must keep blocked to meet legal obligations (for example, invoicing data of companies and agencies) during limitation periods.
- Your rights: you can exercise your rights of access, rectification, erasure, objection, restriction and portability by writing to . You can also correct your details, switch off your availability, replace your CV or close your account from your dashboard at any time. If you believe your rights have not been respected, you may lodge a complaint with the Spanish Data Protection Agency (www.aepd.es).
6. Cookie policy
A cookie is a small file that a website stores in your browser. We use the following:
- Technical cookies (necessary): WordPress login cookies (
wordpress_logged_in_*,wordpress_sec_*,wordpress_test_cookie), the chosen language (ea_lang, 1 year) and your cookie choice (ea_consent, 6 months). They are essential for the site to work and do not require consent. - Analytics cookies (optional): Google Analytics (
_gaand_ga_*, up to 2 years), by Google Ireland Ltd. They tell us statistically how the site is used. They are only set if you click «Accept» in the cookie notice.
You can change your choice at any time using the «Cookie settings» link in the footer. If you reject analytics cookies, we delete them. You can also delete or block cookies in your browser settings; if you block technical cookies, some features such as signing in will stop working.
7. Liability
The owner is not responsible for the accuracy of information provided by users, companies’ hiring decisions, the employment conditions agreed, or rental agreements between candidates and agencies. Nor is the owner liable for service interruptions due to maintenance, technical failures or causes beyond its control, although it will do its best to restore the service as soon as possible.
8. Intellectual property
The Platform’s design, texts, logos and software belong to the owner or its licensors. Users retain ownership of the content they publish (CVs, property photos, descriptions) and authorise the owner to display it within the Platform in order to provide the service.
9. Changes to these terms
We may update these terms to reflect legal or service changes. We will publish the new version with its date and, if the changes are significant, notify registered users by email.
10. Governing law and jurisdiction
These terms are governed by Spanish law. For any dispute, the parties submit to the courts of Málaga, unless consumer protection law grants the user a different jurisdiction.
